The petitioner apprehends his arrest in Salkhua P.S. Case No. 13/2015, registered for the offence punishable under Section 409 and other sections of the Indian Penal Code. Petitioner and others are alleged to have misappropriated huge amount.
It is submitted that petitioner was Secretary of Vidyalaya Shiksha Samiti since 11.04.2008 to 16.06.2009 for the financial year 2009-10. From perusal of page 21 of the F.I.R. it appears that Rs. 29/- and Rs. 1273/- only meager amount is alleged to have been misappropriated by the petitioner and others. It is submitted that similarly situated co-accused already been granted anticipatory bail.

No.16608 of 2016 (3) dt.05-07-2016 2/2 Considering the facts aforesaid and the fact that petitioner was Secretary of Vidayalaya Shiksha Samiti for the financial year 2009-10 and meager amount is alleged to have been misappropriated, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 13/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
