Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 290, 34 of the I.P.C and Section 47(a) of the Excise Act. From the shop of the petitioner foreign and country made liquor were recovered when the petitioner managed to escape from the scene.

It is submitted by learned counsel for the petitioner that neither anything has been recovered from the possession of the petitioner nor the seizure list bears the signature of any family member of the petitioner. The First Information Report was registered on 23.08.2014 when it reached to the learned Court below on 25.08.2014 which suggests antedating of the F.I.R.

A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.9528 of 2015 (2) dt.20-04-2015 2/2 petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of regular bail. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection with Udwantnagar P.S. Case No. 306 of 2014, pending in the Court of learned Chief Judicial Magistrate, Bhojpur, Ara.

Accordingly the application is disposed off.
