JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.
The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 498A, 406, 494, 114 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Allegedly, the petitioner and other in-laws in the family tortured the complainant for non-fulfillment of demand of dowry. There is also an allegation that the petitioner, who is husband of opposite party no. 2 married another lady on 12.12.2014.
Learned counsel for the petitioner does not dispute
Patna High Court Cr.Misc. No.19043 of 2015 (2) dt.02-07-2015 this fact that the petitioner has married another lady on 12.12.2014 by performing ritual.
In view of the facts and circumstances, I am not inclined to grant the petitioner privilege of anticipatory bail. The application is accordingly rejected.
The petitioner is directed to surrender before the learned court below within two weeks from today and seek regular bail, if so advised.
