ANJANA MISHRA ORAL ORDER 06-03-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 22.09.2017 in connection with Jankinagar P.S. Case No.166 of 2017 registered for the offence under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that though it is stated that the petitioner was fleeing away from the place of occurrence and had been apprehended by the villagers, there is no independent witness in the case nor has any recovery been made from the possession of the present petitioners. It is further submitted that the petitioners

No.8516 of 2018 (3) dt.06-03-2018 2/2 are not having any criminal antecedents and a similarly situated co-accused Ramu Kumar, who has also been apprehended in the similar manner, has been extended the privilege of regular bail in Cr.Misc. No.6018 of 2018, vide order dated 21.02.2018. Having considered the entire facts and circumstances and in view of the fact that no T.I. parade is being conducted and also that the petitioners have got no criminal antecedents, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea, in connection with Jankinagar P.S. Case No.166 of 2017.
