====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-06-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioners seek bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)A, 26, 27, 35 of the Arms Act. Petitioners are said to have been caught along with some others while they had assembled to make preparation for committing dacoity. Admittedly, nothing was recovered from possession of the petitioners and moreover, para 3 of the petition goes to show that petitioners do not have any criminal antecedent. Petitioners are languishing in jail custody since

Patna High Court CR. MISC. No.12876 of 2020(2) dt.09-06-2020 2/2 13.01.2020 whereas according to submission of learned counsel of the petitioners, having similar allegation one co-accused has already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 08 of 2020.
