The petitioner seeks bail in connection with Fulwariya P.S. Case no. 159 of 2016 registered for the offence punishable under Sections 341, 323, 325, 307, 379, 506, 504, 420 and 406/34 of the Indian Penal Code.

The informant has alleged that on 15.12.2016 when he had gone to the place of the petitioner for demanding his dues to the tune of Rs. 2 lacs, this petitioner and other co-accuseds threw him on the ground and this petitioner assaulted him by iron rod on his head. He further snatched Rs. 10,000/- from his pocket when he was unconscious.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.32784 of 2017 (2) dt.20-07-2017 petitioner is a Yogacharya associated with several institutions and he has been made accused with false and frivolous allegations. The injury allegedly sustained by the informant has been found simple in nature and so he deserves bail.

Learned APP, on the other hand, opposed the submissions.

On perusal of the written report, I find that there is allegation of giving a single blow on the head of the informant which has been found simple in nature by the doctor. The petitioner is in custody since 22.02.2017.

Considering the facts and circumstances of the case, the bail prayer of this petitioner is allowed. The petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sri Raghubir Prasad, Judicial Magistrate, 1st Class, Begusarai in connection with Fulwariya P.S. Case no. 159 of 2016.
