KUMAR ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners, who are in custody, seek bail in connection with Naubatpur P.S. Case No. 274 of 2017 registered for the offence punishable under Sections 147, 148, 149, 323, 324, 325, 326, 307, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Informant in his written complaint has stated that on 05.09.2017 he alongwith his son and nephew was in his field and after harvesting Masuriya they were returning to their house, in the way Birju Yadav, Ram Anuj Rai, Mithilesh Yadav and other accused abused and assaulted them by country made pistol and sword, due to which Ravi Shekhar succumbed to his
Patna High Court Cr.Misc. No.13991 of 2018(3) dt.05-04-2018 2/2 injuries. Petitioners are not named in the FIR. Their name has transpired during investigation on the basis of statement of one Madhubala Devi and except that statement there is no incriminating material against the petitioners. Petitioners have no criminal antecedent and they are in custody since 12.09.2017.
Learned counsel for the informant has vehementally opposed the prayer for bail to the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. II, Danapur, in connection with Naubatpur P.S. Case No. 274 of 2017.
