JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2017 The petitioner seeks regular bail in connection with Lakhisarai P.S. Case No. 314 of 2012, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that save and except the theory that deceased was last seen with the petitioner along with other co-accused of this case, there is absolutely nothing against the petitioner so as to show his involvement in the present case. Further other co-accused of this case has already been granted anticipatory bail vide order dated 04.09.2017 passed in Criminal Miscellaneous No. 04.09.2016 and petitioner has been in judicial custody since 19.02.2017. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact that the

Patna High Court Cr.Misc. No.25865 of 2017 (4) dt.10-07-2017 2/2 case is of year 2012 and the petitioner was absconding for five year and has been arrested on 19.02.2017, as such, I am not inclined to release the petitioner on bail at least at this stage, his application for regular bail is, accordingly, rejected. However, the petitioner may renew his prayer for bail after framing of charge in this case.
