Petitioner seeks bail in Mithanpur P.S. Case No.435 of 2018 instituted for the offence under Section(s) 364-A/34 Indian Penal Code.

Counsel for the petitioner submits that in the written report there is specific allegation against co-accused Deepak of taking son of the informant on motorcycle.

It is alleged in the written report that son of the informant was doing business of jewellery. Deepak Kumar had taken rupees sixty five thousand from son of the informant. He was not returning the money.

The victim has given statement under Section 164 Cr.P.C. certified copy of which has been produced by the

Patna High Court CR. MISC. No.14158 of 2019(2) dt.07-03-2019 2/2 counsel for the petitioner at the time of hearing of this application, wherein, victim has levelled specific allegation against Deepak. He has alleged that Deepak took him into the room of Shantanu. He has further stated in the statement recorded under Section 164 Cr.P.C. that one Suraj was also present on the motorcycle along with Deepak. Name of this petitioner has been disclosed by the victim on the basis that accused persons were taking the name of this petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, East, Muzaffarpur, in connection with Mithanpur P.S. Case No.435 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
