JUSTICE SATYAVRAT VERMA ORAL ORDER 22-06-2023 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 498(A), 323, 307 and 504 of the Indian Penal Code read with Sections 3⁄4 of the Dowry Prohibition Act.
In compliance of the order dated 15.12.2022, both the petitioner and the complainant are present before this Court along with their respective counsel.
The learned counsel for the petitioner submits that he has instruction to make submission that petitioner is willing to pay monthly maintenance of Rs.3,600/- to the petitioner commencing from 01.07.2023 till the matter is finally
Patna High Court CR. MISC. No.14518 of 2022(8) dt.22-06-2023 2/2 adjudicated in trial or until the maintenance is not fixed by a Court of competent jurisdiction.
The learned counsel for the complainant accepts the submission of the learned counsel for the petitioner with regard to maintenance based on instruction. The learned counsel for the complainant further submits that he will WhatsApp the saving bank account number of the complainant to learned counsel for the petitioner and the learned counsel for the petitioner undertakes to communicate the said bank account number through WhatsApp or by any mode to the petitioner. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 443C of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
