The petitioner seeks bail in connection with Akbarpur P.S. Case No. 711 of 2021 registered for the offence punishable under Sections 302 / 34 of the Indian Penal Code. The allegation against the petitioner is that he alongwith other co-accused persons assaulted the brother-in-law of the informant, who died during his treatment. Learned counsel for the petitioner submits that petitioner is aged about 68 years and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The alleged occurrence took place on 04.11.2021, however, the farde beyan was reduced to writing on 08.04.2021 i.e. 4 days delay without any explanation. The petitioner has no criminal antecedent and he is in jail custody
Patna High Court CR. MISC. No.15836 of 2023(2) dt.15-05-2023 2/2 since 28.09.2022. The charge sheet has already been filed in this case and there is no chance of absconding or tampering with the evidence.
Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 711 / 2021.
