20-06-2024 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the complainant / opposite party no. 2.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 504, 406, 420, 34 of the Indian Penal Code.

3. It is alleged that despite taking consideration money, petitioners refused to execute the sale-deed in favour of the complainant/opposite party no. 2, nor returned the alleged amount.

4. It is submitted on behalf of petitioners that from bare perusal of the complaint petition, it is apparent that entire

Petitioners have not received a single penny from the complainant. The cheques in question have been issued by the co-accused Mukesh Kumar, which got bounced due to insufficiency of fund. Petitioners have been made accused in this case merely because they happen to be full brothers of co-accused Mukesh Kumar. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State and learned counsel for the opposite party no. 2 vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya in connection with Complaint Case No. 464 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
