2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Aurangabad (Town) P.S. Case No. 108/2024 registered for the offence under Sections 406, 409, 420, 467, 468, 379 of the Indian Penal Code Act.

3. According to the case of prosecution, it is alleged that the petitioner embezzled Rs. 19,22,458/- by making a fake receipt in the name of Sunshine Private limited, while he was working as manager in the said company. On the basis of the complaint made by the informant, offence, has been registered. During the course of investigation, present applicant arrested on

4. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case due to some dispute with the manager of the said company. He further submits that charge-sheet has been filed and petitioner has no criminal antecedent. He is in custody since 25.10.2024. Trial is still going on, it will take some more time, therefore it is prayed that applicant may be granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner and State counsel submitted that looking to the embezzled amount and conduct of the petitioner, he is not entitled to get benefit of bail.

Considering the above submissions made by both the learned counsels and particularly considering the fact that applicant is in custody since 25.10.2024, all the offences are triable by the Magistrate-1st Class, charge-sheet has been filed. Trial is still going on, it will take some more time, petitioner has no criminal antecedent, I am of the view that the petitioner should be enlarged on bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail

Patna High Court CR. MISC. No.13634 of 2025(3) dt.12-05-2025 3/3 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No. 108 of 2024.
