JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Heard the parties through video conferencing in view of the total lock-down on account of COVID-19 pandemic. In this case, the petitioners are seeking regular bail in connection with Sahebganj P.S. Case No. 28 of 2020 registered for offence punishable under sections 272, 273 of the Indian Penal Code and under section 30 (a) of the Bihar Prohibition and Excise Act.
On the basis of the secret information, the shop of the petitioners was searched and about 409 litres of elicit liquor has been recovered from there.
Learned counsel for the petitioners submits that the petitioners are in custody since 28.01.2020.

No.12672 of 2020(2) dt.13-05-2020 2/2 Considering the aforesaid facts, the petitioners, named above, are directed to be released on bail on their personal bond to the satisfaction of Special Judge, Excise Act, Muzaffarpur, in connection with Sahebganj P.S. Case No. 28 of 2020, subject to the condition that if the petitioners are found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of their bail bonds.
