2. The petitioner is apprehending arrest in connection with Turkauliya P.S. 282 of 2024 registered on 08.06.2024 for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

3. As per prosecution, the F.I.R. has been lodged against the sole petitioner. The petitioner is alleged to have defalcated government money of Rs.1,95,434/-.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. However, he has returned the alleged defalcated amount which

Thereafter, vide annexure -3 series, the order of 'Put Off duty' of the petitioner has been revoked by the Superintendent of Post Offices, Champaran Division, Motihari. The antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that though the allegation of defalcation of government money is against the petitioner, but he has returned the said amount as is evident from the document annexed by the petitioner in the petition.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the ACJM, 6th Floor, East Champaran at Motihari, in connection with Turkauliya P.S. 282 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
