The petitioner is aggrieved with the action of the respondent no. 4 in issuing the advertisement under the signature of the Director, Panchayati Raj Department, Government of Bihar, Patna, as contained in notice no. 1420 dated 23.01.2025 to the extent specifying the post of "Nyaymitra" in Panchayat Gothahula as a vacant post.

3. Learned Advocate for the petitioner referring to the

Patna High Court CWJC No.4084 of 2025(2) dt.24-03-2025 2/3 averments made in the writ petition has vehemently contended that the petitioner was duly appointed as a Nyaymitra under Bihar Gram Katchary Nyaymitra (Employment Service Condition) Rules, 2007 long back in the year 2007 and later on the service of the petitioner was renewed in the year 2015.

Notwithstanding the fact that the petitioner has been continuously discharging the duty of Nyaymitra in Gram Panchayat Gothahula, the post for Nyaymitra of the said Panchayat has also been advertised by the impugned notice No. 1420 dated 23.11.2025 and, as such, manifest prejudice has been caused. The entire fact has been brought to the knowledge of the concerned authorities, including the District Panchayati Raj Officer but, till date, no action has been taken.

5. Learned Advocate for the State submits that since the petitioner has already brought the entire facts to the knowledge of the District Panchayati Raj Officer who is the competent authority, shall look into the matter as also the grievance of the petitioner and take appropriate action.

6. In view of the submissions advanced on behalf of the learned Advocate for the respective parties, the present writ petition stands disposed off with a liberty to the petitioner to file a fresh representation before the respondent no. 2, preferably

Patna High Court CWJC No.4084 of 2025(2) dt.24-03-2025 3/3 within a period of one week from today.

7. In case such a representation is filed, the respondent no. 2 shall obliged to consider the grievance of the petitioner after obtaining the status report with regard to the post, in question, on which the petitioner claimed to have been working and pass a reasoned and speaking order preferably within a period of four weeks thereafter.
