JUSTICE ARUN KUMAR ORAL ORDER 11-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.8.2017, seeks bail in Patahi PS Case No. 120 of 2016 (S.Tr. No. 1211 of 2017) registered under Section 395 of the IPC and Section 27 of the Arms Act. The allegation in brief is that unknown miscreants looted cash and other items from the informant while he was on way after assaulting and the petitioner's name transpired in the confessional statement of Musafir Sahni and Suraj Tiwary.

Learned Counsel for the petitioner submits that neither any recovery was made from his possession nor he was put on TIP and bail is also sought on the ground of parity as Suraj Tiwary and Musafir Sahni have been admitted to bail by coordinate Benches of this Court vide Cr. Misc. No. 22156 of 2017 and Cr. Misc. No. 14235 of 2017 respectively.

Having considered the said facts and circumstances, the petitioner, namely, Mithu Kumar @ Jangli Baitha is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.21234 of 2018 (2) dt.11-04-2018 satisfaction of 12th Additional Sessions Judge, Motihari in connection with Patahi PS Case No. 120 of 2016 (S.Tr. No. 1211 of 2017).
