JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-03-2019 Learned counsel appearing on behalf of the Purnea University, Purnia, has produced before this Court a notification dated 15.03.2019 issued by the Registrar, Purnea University,
Patna High Court MJC No.751 of 2019(6) dt.26-03-2019 2/2 Purnia, whereby affiliation has been granted in favour of the petitioner, S.R.P. Teachers Training College, Madhopara Line Bazar, Purnea, for the academic year 2019-20. Mr. Shia Ram Shahi, learned counsel appearing on behalf of the petitioner, has submitted that once N.C.T.E. has granted recognition, till the recognition survives, the affiliation with the University has to continue.
The submission made by Mr. Shahi, in my opinion, is correct. At the same time, the University's duty and obligation to monitor and review the functioning of a Teacher's Training College, for a limited purpose, as indicated in the Supreme Court's decision in case of Maa Vaishno Devi Mahila Mahavidyalaya vs. State of U.P., reported in (2013) 2 SCC 617, cannot be disputed.
However, in view of issuance of notification dated 15.03.2019, no case of deliberate disobedience of this Court's order is made out, keeping in mind the subsequent conduct. This application stands disposed of with the observation as above.
