The petitioner is accused in connection with Nursarai P.S. Case No. 149 of 2018, registered under Section 392 of the Indian Penal Code.
The accusation is that on 24.06.2018, informant Yogendra Prasad, along with Rishav Kumar was returning from Parwalpur to Biharsharif boarding on Scooty. In the way, three persons on the point of pistol, took cash of Rs.35,000/- from the dickey of the Scooty and also snatched his double SIM mobile bearing registration nos. 9708453853 and 8541808700 and also snatched mobile bearing registration no. 6200526068 from Rishav Kumar.

No.16035 of 2020(2) dt.04-06-2020 2/2 Learned counsel for the petitioner submits that petitioner is not named in the FIR but in course of investigation, it has come that one looted mobile set was found using SIM No. 7541876951 by one Sita Devi, who disclosed that the said mobile is being used by his son, Satendra Paswan (petitioner). Further submission is that petitioner has not been put on T.I. Parade while he is in custody since 04.12.2019. In fact, petitioner is accused in five other cases, as detailed in paragraph 3 of the petition, due to that reason, police managed to implicated him in the present case.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Nursarai P.S. Case No. 149 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
