JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-04-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code. As per the F.I.R, twelve named accused persons including the petitioners brutally assaulted the son of the informant, as a result of which, he died on spot.

There is general and omnibus allegation against all the accused persons including the petitioners and no specific overt act has been levelled against the petitioners. It is further submitted that in the postmortem report also, the doctor has found blood from right frontal region, size of lacerated wound 1x 1⁄4 x scalp deep, multiple black spot over both legs, palm, forearm, buttock and thorax region, but cause of death of the deceased has been kept reserved. The petitioners are languishing in custody since 12.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like
