Petitioner, already in custody, seeks bail in connection with Kahalgaon P.S. Case No.22 of 2018, registered under Sections 379 and 511 of the Indian Penal Code as well as under Section 174 of the Railway Act.

Allegation in brief is that the petitioner was making attempt to unload the coal from the coal rack of the goods train. Learned counsel for the petitioner contends that except suspicion raised against the petitioner, there is no other material and nothing was recovered from his possession. It is further submitted that the petitioner has clean antecedent and he is in custody since 14.01.2018.

Having considered the aforesaid facts and
