16-06-2015 Heard Sri Subhash Kumar Jha, learned counsel for the petitioner and Sri Amrendra Prasad, learned Addl. Public Prosecutor.
The sole petitioner apprehending his arrest in connection with Rajnagar P.S. Case no.36/2012, corresponding to G.R. No.397 of 2012, registered for the offence under Sections 419, 420, 467, 468, 471, 414, 120(B), 34 of the Indian Penal Code and the Trade and Merchantile Marks Act, 1978,has prayed for grant of anticipatory bail only on the ground that in similar circumstances, one of the co-accused, namely, Lalit Yadav @Laliteshwar Yadav has already been granted anticipatory bail on 27.11.2012 vide Cr.Misc.No.32355 of 2012.
In this case, on perusal of the F.I.R. it appears that the
Patna High Court Cr.Misc. No.19429 of 2015 (2) dt.16-06-2015 2/2 accused were indulged in preparing spurious cement in the Brand name of ACC cement . F.I.R. was lodged in the year 2012 and in the F.I.R., the petitioner's name has been mentioned as one of the accused. Of course, one of the accused has been granted anticipatory bail but the same was granted in the year 2012 itself. The anticipatory bail petition of the petitioner was rejected in the month of December, 2013 and after a long time, the petitioner has approached this Court in the month of April,2015 for grant of anticipatory bail.
In view of nature of accusation, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
