The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 467, 468 and 469/34 of the Indian Penal Code.

The crux of the prosecution case is that the accused persons including the petitioner got their appointment as Niyojit Block Teacher on the basis of forged and fabricated mark-sheets of BETET.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner had already resigned from his service on 07.12.2018 and the appointing authority of the department, i.e., prior to the institution of the present case from

Patna High Court CR. MISC. No. 15344 of 2022(2) dt.12-09-2022 2/2 the post of Panchayat Teacher Primarcy School, Bodhi Bigha, District-Gaya, as such, no offence is made out against the petitioner. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Prem Chand Anal, SDJM, Sherghati, Gaya/concerned Court in connection with Dumariya P.S. Case No. 34 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U
