In this case, the petitioners are apprehending their arrest in connection with Ballia P.S. Case No. 320 of 2014 for offence under Sections 147, 341, 353, 337, 307, 504 of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Property Act.
An allegation has been made that the petitioners have blocked the NH-31 by burning tyre and blocking the same by bamboo and bench. When the Informant reached there to clear the road then they started raising slogan of Murdabad and also started pelting.
Patna High Court Cr.Misc. No.11853 of 2016 (2) dt.16-03-2016 As per claim of the petitioners, there is no specific allegation against any person and no damage has been caused to anything.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Md. Salim and Md. Nepal, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 320 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
