Petitioner, already in custody, seeks bail in connection with Motipur P.S. Case No.452 of 2017, registered under Sections 399 and 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act as well as under Sections 30(a), 38(i) and 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner contends that petitioner is the driver of the car and allegation is that only one bottle of foreign liquor was recovered from the vehicle, the petitioner has clean antecedent and he is in custody since 08.12.2017.
