JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard Mr. Surendra Prasad Singh, learned Senior Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Ghoshi P.S. Case No. 489 of 2020 dated 29.10.2020 instituted for the offences under Sections 341, 323, 308 and 504/34 of the Indian Penal Code.
Though the petitioner has been made accused in this case with the charge of participating in the occurrence but no overt act has been attributed against him. Two of the persons who have been injured in the transaction have received only simple injuries but those injuries also are not attributable to the petitioner.
Regard being had to the aforestated facts and taking into account that two of the other accused persons though ladies
Patna High Court CR. MISC. No.24537 of 2021(2) dt.24-05-2022 2/2 have been granted anticipatory bail by the court below only, the petitioner also is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Ghoshi P.S. Case No. 489 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
