The appellant seeks regular bail in connection with Bettiah Town P.S.Case No.230 of 2017, registered for offences punishable under Section 323, 406, 409, 420 and 506 of the Indian Penal Code and Section 3(i)(r), 3(2)(va) of SC/ST (Prevention of Atrocities Act) Act.
Allegation against the appellant as per F.I.R. is that one S.P. Finance Pvt. Ltd. was dealing with the fixing deposit of the villagers and the appellant was agent of that Company and on his assurance several persons deposited amount Rs.20 and Rs.50/- per day but the Company closed its Branch and the whole money was misappropriated by the appellant and the Company. Submission of the learned counsel for the petitioner is that he is only Agent of the Company and he is in custody since

Having heard both sides in view of the above facts and circumstances, this appeal is disposed of with direction to the court of Special Judge that the appellant is ready to deposit 50 % of the amount as calculated in the F.I.R. in the court within a period of 15 days and once the amount is deposited, the appellant will be released on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge1st-cum-Special Judge, Bettiah, District- West Champaran in connection with Bettiah Town P.S.Case No.230 of 2017, subject to condition, that the appellant shall co-operate in disposal of the trial. The amount so deposited as above shall be released in favour of the informant..
With the above observation, this appeal is disposed of.
