====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in anticipation of his arrest in connection with Sheohar P.S. Case No. 08/2019 instituted for the offences under Sections 406, 409 and 420 of the Indian Penal Code.

As per the prosecution case, on an inspection made by the D.D.C., Sheohar, it was found that the work under the Chief Minister Rural Drinking Water Project in the area was not done appropriately and it was, therefore, suspected that an amount of Rs. 13, 16, 106/- was misappropriated.

Learned counsel for the petitioner submits that the petitioner has not been named in the F.I.R. and it was FIR named accused persons who had withdraw money and the work was to be done by them. Petitioner is only a supplier and claims

Patna High Court CR. MISC. No.24585 of 2021(3) dt.11-07-2022 2/2 to have supplied all the materials for which indent was made and he was paid for the same. Petitioner is the proprietor of Chaitanya Enterprises and there is no accusation against him. FIR named accused persons have already been granted prearrest bail by this Court. Considering the nature of allegation, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar, in connection with Sheohar P.S. Case No. 08/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
