Petitioner seeks quashing of the memo no. 37, dated 20.01.2016, whereby he has been put under suspension by the District Magistrate, Banka.

Petitioner was appointed as clerk in the office of Child Development Project, Shambhuganj in the District of Banka. He was suspended as he locked his office and even remained absent without obtaining any permission. Petitioner submits that the disciplinary proceeding should be concluded within the time frame mentioned in letter no.

Patna High Court CWJC No.5367 of 2016 (2) dt.12-05-2016 2/2 2178/Patna, dated 28.02.2007, issued by the Department of Personnel and Administrative Reforms, Government of Bihar. The Court expects that the authorities while conducting disciplinary proceeding would adhere to the time limit framed under the said Circular of the State Government. With the aforesaid observations, this writ application is disposed of. In case there is delay in conclusion of the proceeding, it would be open for the petitioner to approach this Court.
