In this case, the petitioner is seeking regular bail in connection with G.R. No. 168 of 2019, arising out of Banka Mahila P.S. Case No. 60 of 2019 registered for offence punishable under section 376(D) of the Indian Penal Code and section 4 of the POCSO Act.

Allegation has been made that the victim/informant had been picked up and put to the sexual assault. In the statement recorded under section 164 Cr. PC, the victim has corroborated the aforesaid allegation but learned counsel for the petitioner submits that the allegation made in the FIR is concocted and the petitioner is in custody since 10.12.2019. Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner for the
