The petitioner apprehends his arrest in East Colony P.S. Case No. 62 of 2022 registered for the offences punishable under Sections 341, 323, 325, 384, 387, 386 and 34 of the Indian Penal Code pending in the Court of learned J.M. 1st Class, Munger. As per the prosecution case, the informant alleged that the petitioner along with other co-accused forcefully took him on bike towards Kol Kali and demanded Rs. Two Lac as extortion and when the informant denied he was assaulted with belt, danda causing injury to him.

Learned counsel for the petitioner submits that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature.

He submits that mother of the petitioner has filed a complaint case against the informant before the learned court below vide Complaint Case No. 876C/2022 on 23.09.2022. The petitioner has got two criminal antecedents as mentioned in para3 of the bail application. Learned APP for the State vehemently opposing the bail petition submitted that the petitioner is also involved in the present case, though there is no specific allegation against the petitioner of demanding Rangadari from the informant but the petitioner is the member of the Syndicate, who demanded the said money from the informant.

Considering the facts and circumstances of case, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected. However, if the petitioner surrenders before the learned Court below within six weeks from today and seek regular bail, the learned Court below would pass order on the same day in accordance with law without being prejudiced by this order.
