Petitioner apprehends arrest in connection with Gamhariya P.S. Case No. 119 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact, the wife of the petitioner had illicit relation with one Rajendra Yadav and they had planned to escape and when Rajendra Yadav alongwith other associates came, people of the village stopped them on which Rajendra
Patna High Court CR. MISC. No.16959 of 2019(4) dt.19-06-2019 2/2 Yadav pointed arms upon the villagers, however villagers caught hold of him. In this connection Madhepura (Ghaladh) P.S. Case No. 527 of 2018 (Annexure-2) was also lodged. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, IV, Madhepura in connection with Gamhariya P.S. Case No. 119 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
