The petitioner is in custody in connection with Hajipur Town P.S Case No. 1030 of 2023 registered for the offences punishable under Sections 379, 420, 411 and 34 of I.P.C and Section 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining Storage and Transportation) Rules, 2019 and Section 15 of the Environment Protection Act, 1986.

3. As per prosecution case, it is alleged that police seized loader vehicle loaded with illegal sand. Petitioner is the owner of the seized loader vehicle with Chassis No. MBNWHBDUBHNE00357 and Engine No. NHE2WBE0352.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.15201 of 2025(3) dt.14-05-2025 2/2 petitioner has falsely been implicated in this case. It is further submitted that petitioner is the owner of the seized vehicle. It is further submitted that petitioner is not named in the FIR. It is also submitted that petitioner is in judicial custody since 06.09.2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that petitioner is the owner of the seized loader vehicle and he is not named in the FIR. Petitioner is not arrested on the spot and he is in custody since 06.09.2024.

7. Considering the aforesaid facts and circumstances of the case, materials available on reocrd and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Incharge CJM, Vaishali in connection with Hajipur Town P.S Case No. 1030 of 2023.
