JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 51 of 2013 registered for the offences punishable under Sections 420, 467, 468, 471/34 of the Indian Penal Code.

The allegation against the petitioner is that he has signed on the deed of Kirayanama on behalf of Vijayendu Prakash and besides that he has got no concern. The cheque was given by Priyesh Kumar Singh which was dishonoured and that Priyesh Kumar Singh has been allowed pre-arrest bail vide Cr.

Patna High Court Cr.Misc. No.24026 of 2014 (3) dt.15-01-2015 Misc. No. 46164 of 2013 whereas Vijayendu Prakash has been allowed regular bail.

Submission is that admittedly, no amount was due on the petitioner payable to the informant and his implication in the present case is malicious one.

In vie of the nature of accusation and considering the entirety of the case, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra in connection with Chapra Town P.S. Case No. 51 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
