The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code, Section 27 of the Arms Act and Sections 3 / 4 of the Explosive Substance Act. Allegation is that the F.I.R. named accused persons alongwith 600-700 unknown persons exploded bombs upon procession and also pelted bricks & stones upon procession, as a result of which, many people became seriously injured. It is submitted on behalf of petitioner that though, petitioner is named in the F.I.R., but there is no specific overt act, as alleged in the F.I.R., against him. General and omnibus allegation has been made. It is further submitted that some of the similarly situated co-accused persons have already been granted anticipatory bail by this Hon'ble Court, vide Annexure - 2 to the petition. Petitioner claims clean antecedent.
Patna High Court CR. MISC. No.15036 of 2022(2) dt.23-08-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Pirbahore P.S. Case No. 63 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
