2. The petitioner seeks regular bail in connection with Biraul P.S. Case No. 57 of 2016 registered for the offence under Sections 147, 148, 149, 341, 323, 337, 504, 506 and 302 of the IPC.

3. As per the prosecution case, the petitioner along with other accused persons assaulted the informant and her husband with lathi, danda and piece of brick due to which informant's husband sustained injuries and died on the spot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 28.11.2024. He further submits that after investigation, charge-sheet was submitted against five

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Biraul/concerned Court below in connection with Biraul P.S. Case No. 57 of 2016.

8. This application for regular bail stands allowed.
