The petitioner seeks bail in Nath Nagar P.S. Case No.554 of 2020, registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code. The allegation against the petitioner is that the petitioner along with other co-accused persons killed the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is named in the FIR, but there is no specific allegation against the petitioner. It is further submitted that there is no eye witness of the occurrence. The only allegation against the petitioner is that the petitioner was seen in

It is further submitted During investigation, the police recorded the statement of one Adhik Lal Mandal in which he had stated that he had seen the petitioner along with the deceased and Kailash Mandal in the Bahiyar and only on suspicion, the petitioner is made accused in this case. The petitioner is in custody since 08.09.2020 and she has got no criminal antecedent as stated in paragraph 3 of the bail petition.

Having considered the facts that there is no specific allegation against the petitioner and the petitioner is made accused in the present case only on suspicion, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Bhagalpur in connection with Nath Nagar P.S. Case No.554 of 2020.
