2. Interlocutory Application No. 01 of 2023 has been filed for condonation of delay of about six days in filing MJC No. 568 of 2023 for restoration of Letters Patent Appeal No. 134 of 2021 which stood dismissed for non-compliance of office objections on 19.01.2023.

For the reasons stated in the application read with affidavit, delay of about six days in filing MJC No. 568 of 2023 for restoration of Letters Patent Appeal No. 134 of 2021 which stood dismissed for non-compliance of office objections on 19.01.2023 is condoned. Accordingly, I.A. No. 01 of 2023 is allowed.

4. Heard MJC No. 568 of 2023.

5. The present MJC No. 568 of 2023 (Restoration) has been filed for recalling the order dated 19.01.2023 passed in LPA No. 134 of 2021.

6. For the reasons stated in the application read with affidavit and in the interest of litigant, order dated 19.01.2023 passed in LPA No. 134 of 2021 stands recalled and restored to its original file and number subject to payment of cost of Rs. 2000/- (Rupees Two Thousand Only). Cost shall be remitted in the Lawyers' Association Welfare Benevolent Fund, Indian Bank, Branch - LNMI, Bailey Road, Patna, IFSC No. IDIB000L501 having Bank Account No. 7801893276 within a period of eight weeks.

7. Accordingly, the present MJC No. 568 of 2023 (Restoration) stands allowed.

8. Registry is requested to list Letters Patent Appeal No. 134 of 2021 before the concerned Roster Bench at the earliest.
