The petitioner is in custody in connection with Danapur P.S. Case No. 525 of 2018 for the offences under Sections 399, 402 of the Indian Penal Code and Section 25(1B)a, 26, 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 08.01.2019. He further submits that petitioner was not apprehended on spot and nothing was recovered from the conscious possession of the petitioner and similarly circumstanced co-accused namely Santosh Kumar @ Bakaria have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 79879 of 2018 vide order dated 16.01.2019.

No.15614 of 2019(2) dt.13-03-2019 2/2 Considering the fact that petitioner has no criminal antecedent and similarly circumstanced co-accused namely Santosh Kumar @ Bakaria have been granted bail by coordinate Bench of this Court, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate-I, Danapur in connection with Danapur P.S. Case No. 525 of 2018.
