The petitioner seeks bail in Bhagalpur G.R. P.S. Case No. 22 of 2017 registered under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
Some miscreants are said to have assembled in the train to commit loot and on tip off, one of the accused persons, namely, Nitish Kuamr was apprehended with arms and ammunitions and others managed to escape taking the benefit of darkness. The apprehended accused disclosed the name of the petitioner in the occurrence.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.33981 of 2017 (2) dt.20-07-2017 2/2 that there is nothing cogent on the record to indicate the complicity of the petitioner in the occurrence barring confessional statement of the co-accused, namely, Nitish Kumar which has no evidentiary value in the eye of law. He has no concern with the aforesaid occurrence and he has been falsely implicated in this case. The petitioner has been languishing in custody since 18.04.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Bhagalpur in connection with Bhagalpur G.R. P.S. Case No. 22 of 2017 (Prakash Chandra Jaiswal, J) Mishra/- U T
