KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner who is in custody seeks bail in connection with Kotwali P.S. Case No. 136 of 2017 registered for the offence punishable under Section 386/34 of the Indian Penal Code.

The allegation against the petitioner is that on 26.03.2017 at about 1.30 P.M. one Mustaque Khan alongwith three accompanies entered into the flat of the informant and demanded glass of water and he went to bring the glass of water for their drinking they took away ornaments, Rs. 70,000/- cash and one ring costing Rs. 5 crores. It has been further alleged that the Maruti Van on which they fled away from the place of occurrence belongs to petitioner.

Patna High Court Cr.Misc. No.38810 of 2017 (2) dt.19-08-2017 Learned counsel for the petitioner submits that he is not named in the FIR and is innocent and has committed no offence and has falsely been implicated in this case only on the basis of suspicion and has got no criminal antecedent. Petitioner is in custody since 06.04.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 136 of 2017.
