The petitioner seeks bail in anticipation of his arrest in connection with M.M.C.H P.S. Case No. 263/2019 instituted for the offences under Sections 420, 467, 471/34 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that the accusation is absolutely vague and does not signify anything. The forwarding letter has been made the substance of F.I.R. which indicates that on the orders of superior authorities, the F.I.R. has been registered. There appears to be some irregularity in
Patna High Court CR. MISC. No.12629 of 2020(3) dt.05-10-2021 2/2 submission of form of the students and granting them leave certificates. The petitioner at the relevant time was an Assistant Teacher in the school in question. A departmental proceeding also has been initiated against him. He retired from service wayback in the year 2016.
Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Gaya, in connection with M.M.C.H P.S. Case No. 263/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
