JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Bhimpur P.S. Case No. 03 of 2019, registered under Sections 420, 406 and 409/34 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate-II, Supaul.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.24443 of 2021(2) dt.28-07-2021 2/2 prayer for pre-arrest bail of the petitioner has already been refused on merit vide order dated 04.07.2019 passed in Criminal Misc. No. 37197 of 2019 with direction to the petitioner to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.

Having considered the facts and circumstances of the case, I find no ground to reconsider the prayer for pre-arrest bail of the petitioner. Accordingly, the prayer for pre-arrest bail of the petitioner stands rejected.
