JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through video conferencing in view of the total lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Atri P.S. Case No. 484 of 2019 registered for offence punishable under sections 272, 273 of the Indian Penal Code and under section 30 (a) (d) of the Bihar Prohibition and Excise Act.

Allegation has been made that 30 litres of mahua liquor has been recovered. It has been alleged that about 1100 litres Java Mahua has been thrown in the canal and four persons, including this petitioner have been arrested at the spot. Learned counsel for the petitioner submits that the

Considering the aforesaid facts, the petitioner, named above, is directed to be released on bail on his personal bond to the satisfaction of Special Judge, Excise, Gaya, in connection with Atri P.S. Case No. 484 of 2019, subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
