JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 31-07-2017 The petitioner is an accused in case under Arms Act for recovery of a loaded country made pistol from a dilapidated house on his confession in Pirbahore Police station Case No. 29 of 2017 lodged under sections 384 and 385 of the IPC. Learned counsel for the petitioner submits that the recovery is not from the personal possession of the petitioner and he has already been granted regular bail in the said case and the so called confession was made by force.

In the facts and circumstances of the case, the petitioner as mentioned above is directed to be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Pirbahore Police station Case No. 32 of 2017.
