====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 363 and 366(A)/34 of the IPC. The prosecution story, in brief, is that on 07.10.2019 at about 6.00 P.M., in the evening, friend of informant's daughter, namely, Soni Kumari, Niraj Kumar @ Rajababu, Surendra Bhagat, Meena Devi (petitioner), Raj Kumar and Rambha Devi came at the Darwaza of the informant from four wheeler and called his daughter. Upon which, his daughter came near the vehicle, the informant also came behind his daughter. Co-accused Neeraj Kumar and Rajababu forcibly took the informant's daughter and sat on the vehicle. Patna High Court CR. MISC. No.12684 of 2020(2) dt.05-03-2020 2/3 went to rescue his daughter, co-accused Raj Kumar pointed the pistol on the temple of the informant and threatened to kill him. Thereafter, they kidnapped the daughter of the informant and fled away.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 07.12.2019. The petitioner has got no criminal antecedent. She has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner happens to be the mother of Neeraj Kumar @ Rajababu. The victim is said to have been eloped with the son of the petitioner. The petitioner has been made accused just because she happens to be the mother of said co-accused Neeraj Kumar @ Rajababu. The petitioner is a lady.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. East Champaran, Motihari, in connection with Turkauliya
