2. The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 12 of 2024 registered for the offence under Sections 341, 323, 307, 447, 448, 504, 506, 34 of the Indian Penal Code and 27 of the Arms Act. Later Section 302 of the Indian Penal Code was also added.
3. As per the prosecution case, the petitioner and others are said to have fired upon the victim who died after 11 months from the date of alleged occurrence.
4. The petitioner is in jail since 10.12.2025.
5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the the co-accused Krishna Kumar
Patna High Court CR. MISC. No.17097 of 2026(2) dt.24-04-2026 2/2 and one other co-accused has already been granted bail. He next submits that the main allegation of firing is against one Lal Babu Sahni.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Bibhutipur P.S. Case No. 12 of 2024.
8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
