The Petitioner seeks bail in Nawada Town P.S. Case No. 736 of 2016 registered for the offence punishable under Sections 420, 437, 468 of the Indian Penal Code. It has been alleged by the informant that one Khairun Nisha, when she was summoned by the Officer-inCharge of the P.S. regarding issuance of SIM in her name, has stated before the police that the proprietor of Khushi Mobile Shop, Gautam Kumar got issued SIM Card in her name by forgery and she is not using the said SIM. On the basis of the said written statement FIR was drawn and the case was investigated by the police. The petitioner is not named in the FIR but during

Patna High Court Cr.Misc. No.33103 of 2017 (2) dt.20-07-2017 2/2 investigation, it has come that he was also involved in issuance of such false SIM Card. It has further been submitted that similarly situated co-accused Gautam Kumar has been gratned bail by a co-ordinate bench of this Court vide order dated 27.03.2017 in Criminal Miscellaneous No. 12032 of 2017. The petitioner is in custody since, 24.01.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 736 of 2016.
