Petitioner, already in custody, seeks bail in connection with Shastri Nagar P.S. Case No.555 of 2017, giving rise to Special Case No.698 of 2017, registered under Section 376 of the Indian Penal Code as well as under Sections 3(i)(iii)(xi)(xii)(x)/3(2) and 67(A) of the I.T. Act.

Allegation in brief is that the prosecutrix was married in the year 2011 but she had acquaintance with the petitioner since 2008 and the petitioner also made physical relationship with her. Even after marriage, the petitioner asked for physical relationship on the pretext of disclosing the relationship. Learned counsel for the petitioner submits that as per

Patna High Court Cr.Misc. No.13061 of 2018(2) dt.06-03-2018 2/2 allegation itself, she was in consensual relationship since the year 2008 and the case is lodged in the year 2017, the petitioner is in custody since 21.09.2017 and he has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Sunil Kumar Agrawal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge-II, Patna in connection with Shastri Nagar P.S. Case No.555 of 2017, giving rise to Special Case No.698 of 2017.
