JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,353,323,271,278,285 and 504 of the Indian Penal Code.

The prosecution case is that on receiving confidential information the informant being Officer Incharge of Gamhariya Police station reached to the spot and found that Singeshwar - Supaul Road was blocked by the mob. The informant made effort to clear the blockade and pacified the mob but the accused persons instigated the mob resulting in pelting of stone. It is submitted by the learned counsel for the petitioner that no injury was caused to any one and the accusation is against the mob.

No.16652 of 2016 (2) dt.19-04-2016 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Gamhariya P.S. Case No. 115 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
